Terms of Service
These Terms of Service govern your use of Gynus, which is operated by Kedson Alves da Silva ("we," "us," or "our"). By downloading, accessing, or using the Gynus mobile application and related services, you agree to these Terms. If you do not agree, do not use Gynus.
1. Eligibility
You must be at least 13 years old, or the higher minimum age required by local law, to use Gynus. If you use Gynus on behalf of an organization, team, or other group, you represent that you have authority to bind that entity to these Terms.
2. What Gynus Is
Gynus is a group workout habit app for small crews. It lets users join one or more groups, log workouts, optionally attach photos and captions, and interact with other members through comments, reactions, shared progress tracking, streaks, and achievements.
3. Accounts and Access
You are responsible for using Gynus only through a profile you are authorized to access. You are also responsible for maintaining the security of your device, login credentials, access code, and any other authentication information tied to your use of the app.
You must provide accurate information where the app asks for it, and you must not impersonate another person or misrepresent your affiliation with a group.
4. Your Use of the Service
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use Gynus for your personal, non-commercial use.
You may not:
- Use Gynus in violation of any applicable law or regulation
- Access or attempt to access accounts, groups, systems, or data you are not authorized to use
- Interfere with the operation, security, or integrity of the app or its backend systems
- Upload malware, harmful code, or content intended to disrupt the service
- Scrape, harvest, or bulk extract data from Gynus without our written permission
- Reverse engineer or attempt to derive source code from the app except where prohibited by law from restricting that activity
- Use Gynus to harass, abuse, threaten, or invade the privacy of other users
5. User Content
You may submit content such as workout logs, captions, photos, comments, reactions, profile information, and group-related text ("User Content"). You retain ownership of your User Content.
However, by submitting User Content through Gynus, you grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, adapt, display, and distribute that content only as reasonably necessary to operate, improve, secure, and provide the service to you and your groups.
You represent that you have the rights necessary to submit your User Content and that your User Content does not violate the law or the rights of others.
6. Group and Community Rules
Gynus is designed for shared group accountability. By using social features in the app, you understand that other members of your group may be able to see your display name, profile image, workout logs, captions, uploaded photos, comments, reactions, and your contribution to shared progress, streaks, and achievements.
You must not post content that is illegal, defamatory, infringing, sexually explicit, hateful, threatening, or otherwise abusive. We may remove content or restrict access if we reasonably believe it violates these Terms, harms other users, or exposes us to legal or security risk.
7. Health and Safety Disclaimer
Gynus is a habit and accountability tool, not a medical service, healthcare provider, personal trainer, or emergency service. Content shown in the app, including progress metrics, streaks, or user posts, is for general informational and motivational purposes only and is not medical, fitness, or safety advice.
You are solely responsible for your exercise choices, physical condition, and safety. Consult an appropriate medical or fitness professional if you have questions about exercise, health conditions, or injury risk. Never ignore professional advice because of information presented in Gynus.
8. Privacy
Your use of Gynus is also subject to our Privacy Policy, which explains how we collect, use, disclose, and protect information related to the service.
9. Third-Party Services
Gynus relies on third-party infrastructure and platform providers to function, including mobile platform providers, app stores, cloud services, database and storage providers, and authentication services. Your use of those third-party services may also be subject to their terms and privacy policies.
10. Service Availability and Changes
We may change, suspend, or discontinue any part of Gynus at any time, with or without notice. We do not guarantee that the app or any feature will always be available, uninterrupted, secure, or error-free.
We may release updates, bug fixes, or feature changes, and some updates may be required for continued use of the app.
11. Suspension and Termination
We may suspend, restrict, or terminate your access to Gynus if we reasonably believe you have violated these Terms, created risk for other users, misused the service, or if continued operation of the service is no longer practical.
You may stop using Gynus at any time. Termination or stopping use does not automatically delete backend data that already exists; data handling is described in the Privacy Policy and may require a separate deletion request.
12. Intellectual Property
Except for your User Content, Gynus and its design, software, text, graphics, branding, and other service content are owned by us or our licensors and are protected by applicable intellectual property laws. These Terms do not grant you any ownership rights in Gynus or its underlying technology.
13. Disclaimers
To the fullest extent permitted by law, Gynus is provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, or statutory. We disclaim, to the fullest extent permitted by law, implied warranties such as merchantability, fitness for a particular purpose, title, and non-infringement.
14. Limitation of Liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunities arising out of or related to your use of Gynus.
To the fullest extent permitted by law, our total liability for all claims arising out of or related to Gynus will not exceed the greater of the amount you paid us, if any, for the service in the 12 months before the event giving rise to the claim, or USD 50.
Some jurisdictions do not allow certain limitations of liability, so some of the limitations above may not apply to you.
15. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will update the effective date above and, where required, provide additional notice. Your continued use of Gynus after updated Terms become effective means you accept the revised Terms.
